Despite its long history of refugee crises, Asia lacks effective refugee protection mechanisms. Most Asian states resist ratification of the international refugee laws, and many international organizations are ineffective and lack concrete legal and political approaches to protecting refugees. Asian civil society, particularly Asia Pacific Refugee Rights Network, collaborates to protect refugees by employing alternative frameworks. This paper argues that Asian civil society aims to challenge the nature of refugee protection in Asia. Instead of encouraging states to ratify the 1951 (...) Convention Relating to the Status of Refugees and 1967 Protocol Relating to the Status of Refugees, APRRN stimulates national-level implementation of refugee protection principles and practices from below. It engages its members in global decision-making by mobilizing and sharing resources with them. Background: Whenever there has been a worldwide contagious disease outbreak, there have been reports of infection and death of healthcare workers. Particularly because emergency nurses have contact with patients on the front line, they experience ethical problems in nursing while struggling with infectious diseases in an unfavorable environment. Objective: The objective of this study was to explore emergency nurses’ ethical problems and to identify factors influencing these problems during the outbreak of Middle East respiratory syndrome–coronavirus in Korea. Design and sample: (...) For this cross-sectional study, a questionnaire survey was conducted with emergency nurses working in six hospitals selected through convenience sampling from the hospitals designated for Middle East respiratory syndrome–coronavirus patients in the capital area. Methods: Data were collected from 169 emergency nurses in Korea during August 2015. Ethical considerations: This research was approved by the Institutional Review Board of G University in Korea. Results: The findings of this study suggest that during the Middle East respiratory syndrome–coronavirus outbreak, emergency nurses experienced ethical problems tied to a mind-set of avoiding patients. Three factors were found to influence emergency nurses’ ethical problems (in order of influence): cognition of social stigmatization, level of agreement with infection control measures, and perceived risk. Conclusion: Through this study, we obtained information on emergency nurses’ ethical problems during the Middle East respiratory syndrome–coronavirus outbreak and identified the factors that influence them. As found in this study, nurses’ ethical problems were influenced most by cognitions of social stigmatization. Accordingly, to support nurses confidently care for people during future health disasters, it is most urgent to promote appropriate public consciousness that encourages healthcare workers. (shrink)

By taking the collective character of scientific research seriously, some philosophers have claimed that scientific knowledge is indeed collective knowledge. However, there is little clarity on what exactly is meant by collective knowledge. In this article, I argue that there are two notions of collective knowledge that have not been well distinguished: irreducibly collective knowledge (ICK) and jointly committed knowledge (JCK). The two notions provide different conditions under which it is justified to ascribe knowledge to a group. Ideological indoctrination is explicit and pervasive in China, with the school curriculum used to mould the spirit and character of adolescents, fulfilling ideological and political purposes. But the exact content varies over time. Comparing two versions of textbooks published in 1997 and 2005, this paper depicts the continuities and change in the curricular discourses centred on the notion of ‘good citizen’. While keeping the official status of socialism and the Party leadership untouched, the new textbooks soften the presentation and packaging (...) of the ideological content, very much in tandem with the soft authoritarianism practised since the post‐Deng era when China has been deeply involved in the processes of marketisation, liberalisation and globalisation. The new textbooks also adopt a stance of greater reconciliation with human rights and global citizenship. While being granted more autonomy and rights, young citizens are still expected to shoulder the mission of national revival and socialist modernisation—very much derived from official policies. Even though it has been argued that scientific cognition is distributed, there is no consensus on the exact nature of distributed cognition. This paper aims to characterize distributed cognition as appropriate for philosophical studies of science. I first classify competing characterizations into three types: the property approach, the task approach, and the system approach. It turns out that the property approach and the task approach are subject to criticism. I then argue that the most preferable way to understand distributed cognition (...) in science is provided by the system approach that takes a distributed-cognitive system as the unit of analysis. The function of concepts must be taken seriously to understand the scientific practices of developing and working with concepts. Despite its significance, little philosophical attention has been paid to the function of concepts. A notable exception is Brigandt (2010), who suggests incorporating the epistemic goal pursued with the concept’s use as an additional semantic property along with the reference and inferential role. The suggestion, however, has at least two limitations. First, his proposal to introduce epistemic goals as the third component (...) of concepts lacks independent grounding, except to account for the rationality of semantic change (the Grounding Problem). Second, it is hardly justified to consider epistemic goals as a semantic property (the Misplacement Problem). To remedy these predicaments, we suggest a new perspective that takes concepts as cognitive entities with a 2-layered structure rather than as merely linguistic entities and develop an account of the function of concepts. We provide empirical evidence showing that functional information affects our cognitive processes. It is claimed that the function of concepts is not a semantic property but a type of meta-information regulating a body of concept-constitutive information. (shrink)

A controversy of the Perception is focused on the Mind-Nature relation by Confucian Scholars in 18th century Joseon Dynasty. Chang-Hyup Kim [金昌協], especially, asserted that the Perception should be the unique side of Mind, because the Wise [智: the Mind of Judgment, remarkably about the righteous or not] is one aspect of the Nature. He needs to define the category of Wise and Perception, because the existing definition of Wise as an unprocurable activity of Mind. That might bring a confusion (...) of concepts though The Mind and Nature, in his view. More over he added the essential aspect of Perception to real activity of Perception, and in this point of view, the position of Mind is important to the process of consolidating into Nature. Therefore he asserted that we should perceive the Nature, the essence, in the side of Mind [卽心指性]. This vision of the aim to Nature in the point of Mind, which was reinvestigation of Neo-Confucianism and this was succeeded to the general with academic traditional of Nak School [洛學]. (shrink)

The central theme of this paper is the dispositional/categorical distinction that has been one of the top agendas in contemporary metaphysics. I will first develop from my semantic account of dispositions what I think the correct formulation of the dispositional/categorical distinction in terms of counterfactual conditionals. It will be argued that my formulation does not have the shortcomings that have plagued previously proposed ones. Then I will turn my attention to one of its consequences, the thesis that dispositional properties are (...) not susceptible to intrinsic finks. This thesis was first advanced by me and has ever since stirred up a big controversy, endorsed by some philosophers like Handfield, Bird, and Cohen but rejected by others like Clarke and Fara. Against this background, I will remedy my defense of the impossibility of intrinsically finkable dispositions and then refute some of apparently powerful criticisms of it. And so the upshot is that it is much more reasonable to hold on to the thesis that dispositions are intrinsically unfinkable. This will have the effect of putting the dispositional/categorical distinction on firmer and more secure ground. (shrink)

This book reconsiders the relationship between aesthetics and theological ethics. The primary question it seeks to answer is whether artistic creativity is a morally relevant activity. Drawing on the work of Jonathan Edwards and Thomas Aquinas, Choi argues that the arts are the cultural medium through which we can better understand what is morally possible, and that aesthetic objects can serve as snapshots of a particular community's perspectives on the good life. Art, in other words, offers glimpses not only (...) into competing moral visions within society but also the extent to which these contested moral views are understood. The arts, in Choi's view, provide a way of assessing the limits and possibilities of moral reasoning, the contextuality of moral discernment, and the need for moral thinking that is dialogical and dialectical. BackgroundAn increasing number of studies utilize intracranial electrophysiology in human subjects to advance basic neuroscience knowledge. However, the use of neurosurgical patients as human research subjects raises important ethical considerations, particularly regarding informed consent and undue influence, as well as subjects’ motivations for participation. Yet a thorough empirical examination of these issues in a participant population has been lacking. The present study therefore aimed to empirically investigate ethical concerns regarding informed consent and voluntariness in Parkinson’s disease patients undergoing deep brain (...) stimulator (DBS) placement who participated in an intraoperative neuroscience study.MethodsTwo semi-structured 30-minute interviews were conducted preoperatively and postoperatively via telephone. Interviews assessed participants’ motivations for participation in the parent intraoperative study, recall of information presented during the informed consent process, and participants’ postoperative reflections on the research study.ResultsTwenty-two participants (mean age = 60.9) completed preoperative interviews at a mean of 7.8 days following informed consent and a mean of 5.2 days prior to DBS surgery. Twenty participants completed postoperative interviews at a mean of 5 weeks following surgery. All participants cited altruism or advancing medical science as “very important” or “important” in their decision to participate in the study. Only 22.7% (n = 5) correctly recalled one of the two risks of the study. Correct recall of other aspects of the informed consent was poor (36.4% for study purpose; 50.0% for study protocol; 36.4% for study benefits). All correctly understood that the study would not confer a direct therapeutic benefit to them.ConclusionEven though research coordinators were properly trained and the informed consent was administered according to protocol, participants demonstrated poor retention of study information. While intraoperative studies that aim to advance neuroscience knowledge represent a unique opportunity to gain fundamental scientific knowledge, improved standards for the informed consent process can help facilitate their ethical implementation. This essay examines the structural position of Mengzi’s 孟子 heart of compassion within his theoretical goal of teaching moral self-cultivation. I first investigate Kim Myeong-seok’s account that views ceyin zhi xin as a higher cognitive emotion with a concern-based construal. I argue that Kim’s conclusion is not sufficiently supported by the text of the Mengzi, but is also tarnished by the possibility of constructing a noncognitivist counter-theory of ceyin zhi xin. Instead, I suggest that David Hume’s causation-based approach to sentiment (...) provides an alternative route to reach the theoretical core of Mengzi’s ceyin zhi xin. People’s uniform moral sentiment as the effect of mental causation implies that there is a natural cause universally engraved in the human heart. As Mengzi’s practical teaching of moral self-cultivation begins with recognizing this heart of compassion, his focus is placed not upon the characteristics of the expressed emotion, but upon the universal presence of its natural cause in the human heart which demonstrates our moral potential to care for others. What constitutes a good life? A hedonist’s answer to this question is rather simple— more pleasure, less pain. While hedonism was previously a widely accepted belief, it now suffers from several crucial objections. A challenge particularly vexing to hedonists is the Philosophy of Swine: could it be possible that our lives may be less than that of a theoretical swine? In this essay, I argue that lifetime hedonism, the view of hedonism concerned with one’s total lifelong well-being, does not survive (...) this objection. In particular, I will refute the counterarguments that modern-day hedonist, Ben Bramble, presents against the Philosophy of Swine objection. (shrink)

A popular rejoinder to the potential threat that incommensurability might pose to scientific realism has been the referential response: despite meaning variance, there can be referential continuity, which is sufficient for rational theory choice. This response has been charged with meta-incommensurability, according to which it begs the question by assuming realist metaphysics. However, realists take it to be a rhetorical device that hinders productive discussion. By reconstructing the debate, this paper aims to demonstrate two things. First, there are unexpected commonalities (...) between realists and non-realists, meaning that the charge of meta-incommensurability is more or less exaggerated. Second, meta-incommensurability, which is to be found in the ways to make sense of referential overlap at the token level, still plays a role in the realism debate. (shrink)

To answer the question of what difference the philosophy of history makes to the philosophy of law this paper begins by calling attention to the way that Ronald Dworkin's interpretive theory of law is supposed to upend legal positivism. My analysis shows how divergent theories about what law and the basis of legal authority is are supported by divergent points of view about what concepts are, how they operate within social practices, and how we might best give account of such (...) meanings. Such issues are widely debated in the philosophy of history but are often overlooked in jurisprudential circles. When the legal positivist approach to meanings is contrasted with Dworkin's interpretivism it is clear that what is needed is an alternative to both, in the form of what we might call "historical meanings" and "historical interpretation". While Dworkin's interpretivism gets it right that legal positivism is an inadequate philosophy of law to the extent that it is committed to a "criterial semantics" view of concepts, this paper argues that post-positivism in the philosophy of law need not entail a normative jurisprudence, as Dworkin would have it. This essay examines how eighteenth-century naturalists selected, read, and used textual and visual sources of the past to construct chronologies of the aurora borealis from antiquity to their present. Frequent sightings of the northern lights in Europe from 1707 onward prompted investigations into not only their physical properties but also their historical patterns. These searches encountered a twofold problem. Because the term “aurora borealis” was a seventeenth-century neologism, the recovery of auroras avant la lettre required discerning them amid the various (...) aerial spectacles described in older records. Further complicating the task was the eighteenth-century authors’ suspicion of these documents as tainted by the superstitions of an “unenlightened” past. Nevertheless, these self-proclaimed “enlightened” commentators relied on the very sources they criticized in their search for lost auroras. The essay investigates how different Enlightenment auroral observers fashioned their own criteria for identifying “true” auroras through practices of extricating verbal and visual descriptions in older sources from their original contexts of portentous interpretation. Why would God institute the practice of efficacious petitionary prayer? Why would God not simply give us what we need before we ask? I examine recently proposed solutions to this puzzle and argue that they are inadequate to explain why an omniscient and perfectly good God would act differently in response to prayer. I propose that God has reasons to not always maximize a creature’s good, even in a sinless world, and that petitionary prayer functions as a means to reward (...) those who trust God, to enable us to actively love those we cannot otherwise help, and to give the petitioner personal evidence of God’s existence and care for her, creating a virtuous cycle of increasing faith. I refine this proposal by responding to several objections involving human responsibility and the epistemology of divine action. Along the way, I offer several ways petitioners can recognize God’s having answered a prayer and how God might help us with some common obstacles to prayer. (shrink)

This study investigated the relative contribution of perception/cognition and language-specific semantics in nonverbal categorization of spatial relations. English and Korean speakers completed a video-based similarity judgment task involving containment, support, tight fit, and loose fit. Both perception/cognition and language served as resources for categorization, and allocation between the two depended on the target relation and the features contrasted in the choices. Whereas perceptual/cognitive salience for containment and tight-fit features guided categorization in many contexts, language-specific semantics influenced categorization where the two (...) features competed for similarity judgment and when the target relation was tight support, a domain where spatial relations are perceptually diverse. In the latter contexts, each group categorized more in line with semantics of their language, that is, containment/support for English and tight/loose fit for Korean. We conclude that language guides spatial categorization when perception/cognition alone is not sufficient. In this way, language is an integral part of our cognitive domain of space. (shrink)
